I was about to join a call with my friend, Tax Attorney Eric Green, and some other top tax resolution experts when I saw a Facebook comment from a guy named Brian.
Brian threw a bit of a fit after reading an article I penned. And who can blame him?
He’s been hit hard by the IRS from 2009 to 2012.
They concocted some whimsical number he supposedly owes, and then, guess what?
Yep, they froze his bank accounts at a whopping 100%. OUCH!
It made my heart ache; it seems like they do right before the weekend or holiday, every time.
But here’s the thing, amigo.
And I’m not pulling any punches because I respect you too much.
Knowledge is power. But ignorance… well, ignorance can be damn expensive.
Brian’s experience?
Horrible, yes.
But not unheard of. The IRS can slap you with an SFR (Substitute for Return) if there’s even a whiff that you’ve earned something and didn’t file your returns.
And man, they’re not out there looking to do you any favors.
So here’s the scoop:
That “6-Year Rule” I wrote about?
It’s not just some clickbait nonsense.
If you’ve got your ducks in a row and haven’t received an SFR, the IRS generally only wants you only to file the last 6 years of your tax returns to get you back in their good graces(or as the IRS calls it “Compliant”)
BUT… if they suspect you owe them even a penny from earlier years and you haven’t filed?
They’ll come down on you like a ton of bricks.
And trust me, those bricks hurt.
Now for the silver lining.
Brian, and anyone else being manhandled by the IRS, has the right to file those returns if it reduces what they owe.
So if you’re in a similar fix or know someone who is, stop feeling like a deer in headlights.
